    Trump Administration Plans Major Visa Reforms

    The US government issues 65,000 H-1B visa annually, with an additional 20,000 for advanced US graduates. The Trump administration now aims to tighten the program further beyond the recent $100,000 fee hike. Officials plan to impose new restrictions on how employers use H-1B permits and who qualifies for them.

    Proposed H-1B Rule Changes by DHS

    The Department of Homeland Security has introduced a proposal titled “Reforming the H-1B Nonimmigrant Visa Classification Program.” It seeks to revise eligibility for cap exemptions and increase scrutiny of employers violating visa rules. The plan also includes stronger oversight of third-party job placements. These measures aim to improve the program’s integrity and protect American workers’ wages.

    Impact on Employers and Skilled Workers

    The DHS has not clarified whether it will alter which employers qualify for cap exemptions. Any narrowing could affect nonprofit research organizations, universities, and healthcare institutions that currently benefit. The rule’s publication is expected around December 2025. Thousands of Indian students and professionals may face difficulties due to these stricter rules.

    Shift Toward Wage-Based H-1B Selection

    Reports suggest the Trump administration may replace the traditional lottery with a wage-based system. The H-1B visa, created under the 1990 Immigration Act, allows US companies to hire skilled foreign workers for roles hard to fill locally. Since 2012, about 60 percent of H-1B visas have gone to computer-related jobs, and nearly 75 percent of approvals in 2023 were for Indian applicants.

    Economic and Policy Implications

    H-1B visa holders often earn salaries equal to or higher than American workers with similar experience. US law requires employers to pay either the actual or prevailing wage, along with government fees exceeding $6,000. These upcoming reforms could reshape skilled immigration and significantly influence America’s tech and education sectors.
