Chief Justice of India Surya Kant declined a meeting request from Congress leaders Rahul Gandhi and Mallikarjun Kharge. In a letter dated October 11, he rejected their request for an appointment scheduled for Monday. The leaders wanted to submit a memorandum before the INDIA bloc’s planned march to the Supreme Court. Their memorandum addressed concerns involving Chief Election Commissioner Gyanesh Kumar and alleged irregularities in electoral processes. The opposition leaders sought the CEC’s resignation and demanded action against what they described as vote theft. They also called for authorities to stop the Special Intensive Revision of electoral rolls. Additionally, the memorandum reportedly supported restoring the paper ballot system during elections. However, the CJI explained that discussing matters already pending before the Supreme Court would compromise judicial propriety. He emphasized that the constitutional principle of separation of powers prevents inappropriate discussions about pending cases.

CJI Surya Kant Rejects Meeting Request from Rahul Gandhi and Mallikarjun Kharge

In his letter, Chief Justice Surya Kant explained why the requested meeting would conflict with constitutional principles. He stated that the separation of powers forms an essential part of India’s constitutional basic structure doctrine. According to the CJI, discussing pending judicial matters during a meeting would undermine the judiciary’s institutional independence. He also clarified that the Supreme Court lacked administrative authority to resolve the specific concerns highlighted by Congress leaders. Nevertheless, he reaffirmed the judiciary’s responsibility to protect citizens’ fundamental rights through established legal procedures. The letter emphasized that every Indian citizen could approach the courts to seek enforcement of constitutional rights. Rather than pursuing an administrative meeting, Gandhi and Kharge could invoke the Supreme Court’s judicial powers. The CJI encouraged the leaders to follow appropriate legal procedures for addressing their concerns. He maintained that judicial proceedings offered the proper avenue for examining matters involving constitutional rights.

Chief Justice Surya Kant also informed Congress leaders that the Supreme Court had scheduled hearings concerning similar issues. Those proceedings were scheduled for Tuesday, allowing the court to consider relevant matters through established judicial processes. The CJI invited Gandhi and Kharge to submit their petition on Monday through the available filing procedures. They could physically submit documents at the Supreme Court between 10:30 a.m. and 4:30 p.m. Alternatively, the leaders could use the electronic filing facility to submit their petition online. The e-filing system allows applicants to submit documents at any time, including weekends and holidays. The CJI assured them that the court would consider any properly filed petition at the earliest opportunity. However, the court would follow applicable laws and established procedures while deciding when to hear their petition. His response highlighted the distinction between administrative requests and matters requiring judicial consideration. The letter reinforced the judiciary’s commitment to handling pending cases through formal legal channels.

Earlier, on October 9, several INDIA bloc leaders marched from Parliament towards Vijay Chowk in New Delhi. Following their demonstration, the opposition leaders submitted a memorandum to President Droupadi Murmu outlining their electoral concerns. Mallikarjun Kharge explained that the opposition wanted to communicate its concerns directly to the Chief Justice. However, he acknowledged that political leaders could request an appointment but could not demand one. The Rajya Sabha member emphasized that the opposition respected the CJI’s position and authority. His remarks came as the leaders sought judicial attention regarding their allegations of electoral irregularities. The opposition has repeatedly raised concerns about electoral processes and demanded changes to existing practices. Their demands include addressing alleged vote theft, stopping the electoral roll revision exercise, and restoring paper ballots. The CJI’s refusal redirected their efforts towards formal judicial procedures instead of an administrative meeting. These developments have intensified the political debate surrounding electoral transparency and constitutional accountability.

The INDIA bloc planned to launch its Chalo Delhi March for Democracy towards the Supreme Court on Monday. The protest aimed to highlight opposition demands concerning alleged electoral irregularities and the role of Chief Election Commissioner Gyanesh Kumar. Organisers identified the Barakhamba Road junction as the starting point for the planned demonstration. Rahul Gandhi said the march would bring together people across political parties, genders, castes, communities, and states. He presented the demonstration as a collective effort to raise concerns about democracy and electoral transparency. However, the CJI’s letter clarified that the Supreme Court must address relevant legal questions through judicial proceedings. The opposition leaders can submit petitions, allowing the court to examine their concerns under applicable laws. The planned march reflects continuing political disagreements over electoral administration and democratic safeguards. Meanwhile, the Supreme Court’s position underscores the constitutional separation between political advocacy and judicial decision-making. The next legal developments will depend on petitions filed and proceedings conducted by the court.
