A London court delivered a major setback to fugitive businessman Nirav Modi in an important loan recovery dispute recently. The London Circuit Commercial Court ordered Modi to repay more than USD 10.7 million to Bank of India immediately. Judges ruled that Modi remained personally responsible under a guarantee signed for Firestar Diamond FZE during 2012. Authorities connected the case with the wider Punjab National Bank fraud investigation involving massive financial irregularities nationwide. Investigators stated that Firestar Group companies suffered severe financial troubles after fraud allegations surfaced during 2018 investigations. The ruling strengthened Bank of India’s recovery efforts while increasing legal pressure on Nirav Modi in the United Kingdom.

London Court Orders Repayment in Bank of India Case
The court reviewed loan documents and the personal guarantee signed by Nirav Modi before announcing its decision recently. Bank of India argued that Modi accepted repayment responsibility if Firestar Diamond FZE failed to clear outstanding obligations completely. Judges observed that the company defaulted after financial conditions sharply worsened following nationwide investigations into alleged banking frauds. The court calculated liabilities including unpaid principal dues and additional interest claimed by Bank of India authorities abroad. Officials estimated the total recoverable amount at over USD 10.7 million, exceeding nearly Rs 100 crore currently. The ruling provided major relief to Bank of India after several years of legal proceedings connected with unpaid loans.
Bank of India initiated separate recovery proceedings after Firestar Diamond FZE allegedly failed to repay outstanding dues completely on time. The bank issued repeated notices demanding repayment under the personal guarantee executed earlier by Nirav Modi before investigations began. However, Modi challenged the proceedings and questioned the legal validity of repayment notices issued during the disputed period. His legal representatives argued that authorities failed to communicate repayment demands properly through valid legal procedures during hearings. The defence further claimed that Modi remained outside India when officials issued notices connected with the repayment dispute earlier. Despite these arguments, the London court ruled that authorities served notices correctly through proper communication and legal procedures.

Extradition Battle Intensifies After Fresh Legal Setback
The court observed that officials delivered one repayment notice directly to the prison facility where Modi currently remains lodged abroad. Judges confirmed that Modi’s legal representatives also received another notice copy during proceedings conducted before the court in 2019. The ruling established that Modi remained fully aware about repayment demands raised continuously by Bank of India against him. Court observations highlighted worsening financial conditions within Firestar Group companies after adverse media reports affected business operations severely. Judges referred to Modi’s email acknowledging serious business losses caused by damaging reports and increasing financial liabilities globally. The court concluded that Bank of India lawfully exercised its rights under the valid personal guarantee agreement signed previously.
The latest judgment created another significant setback for Nirav Modi while resisting extradition proceedings initiated by Indian investigating authorities abroad. Modi currently remains in custody within the United Kingdom while continuing legal challenges against extradition efforts pursued by Indian agencies. Earlier this year, the UK High Court rejected his request seeking reconsideration of previous extradition-related legal proceedings completely. Indian agencies, including the CBI and Enforcement Directorate, continue investigating the massive Punjab National Bank fraud allegations actively nationwide. Investigators alleged that fraudulent transactions connected with the scam amounted to nearly USD 2 billion across international operations globally. The recent court ruling strengthened Bank of India’s recovery campaign while adding further legal pressure on Nirav Modi in Britain.
