Nitish Kumar resigned from the Bihar Legislative Council on Monday after winning a Rajya Sabha seat.
He secured election to the Upper House on March 16. Under constitutional rules, he had to give up his state legislature membership within 14 days. March 30 was the deadline.
The Prohibition of Simultaneous Membership Rules, 1950, bars a person from holding seats in both Parliament and a state legislature at the same time. Articles 101 and 190 of the Constitution govern these rules.
Nitin Nabin will also resign from the Bihar Assembly after moving to Parliament. Party sources said state BJP president Sanjay Sarogi will likely submit his resignation formally.
Nitish Kumar Faces March 30 Deadline to Resign
Nitish Kumar must resign as an MLC and step down as Bihar Chief Minister within 14 days of his election to Parliament, as required under the rules. Today, March 30, marks the final day for him to vacate the post.
In a heartfelt message, the 75-year-old announced his decision and said he wanted to remain part of both the Bihar Legislature and Parliament. He also reaffirmed his commitment to building a “developed Bihar” and promised his “cooperation and guidance” to the new government.
The National Democratic Alliance (NDA) welcomed Kumar’s decision and praised his return to parliamentary politics.. Sources said Nabin delayed the process because of an urgent meeting in Delhi. Both leaders were expected to complete the formalities on Monday.

Nitish Kumar built his political career on sharp coalition manoeuvring and a series of high-stakes ideological shifts. He began his journey as an MLA in 1985, later served as a Union Minister in the Vajpayee government, and rose to the post of Bihar Chief Minister in 2005 as a key pillar of the NDA.
Since 2013, Kumar has repeatedly reshaped Bihar’s political landscape by switching between the BJP-led NDA and the Mahagathbandhan of the RJD and Congress in 2013, 2017, 2022 and 2024. Despite these frequent realignments, he has continued to outlast rivals and retain his political relevance.
Most recently, Kumar secured a fifth sweeping electoral victory in 2025 and took oath as Bihar Chief Minister for a record tenth time. With his resignation now official, Bihar’s political focus has shifted firmly to the race for the next chief minister.
